These Terms and Conditions of Sale regulate Orders placed with BLOOMFUS, SL (hereinafter, Bloomfus) by the Buyer and will automatically become a Contract between the parties, starting to apply from the moment of acceptance of the Quote and/or Order request. This implies the Buyer’s prior knowledge and express and unreserved acceptance of these Conditions, which will apply in all their terms, unless otherwise expressly indicated in the Order or Quote; in this case, the latter will have priority.
Bloomfus, SL, with registered office at Carrer de Sant Josep, 22, 08700 Igualada (Barcelona) and CIF B19373331, is registered in the Mercantile Registry of Barcelona, Volume 1000428227777, Folio 1, Sheet B 621275, Registration 1.
1. ORDERS
For the Buyer, orders are final from the moment of payment of the down payment. The Buyer may not cancel the order placed if the product in question is custom-made or exclusively personalized. Orders between Bloomfus and its customers must always be in writing by email in order to avoid errors. In the case of personalized or custom-made items, the Buyer can consult the deadlines at info@bloomfus.com.
2. PAYMENTS
Payments can be made by bank transfer or bizum . In case of requiring another type of payment, the Buyer can contact Bloomfus. The order will not be confirmed until the agreed amount has been received in the Bloomfus account.
3. DELIVERIES
The preparation times for products in stock are 3 to 5 days from the time payment has been confirmed. For orders with references not in stock, please check the date indicated in the confirmation.
These dates may vary and be changed without prior notice. Transit time ranges from 3 to 15 business days depending on the region or country of destination and conditions within the EU.
The Buyer declares to have ensured that the conditions of access to the delivery location allow the effective delivery of the product without special equipment. In the event that the delivery requires the use of specific equipment (for example, forklifts), the Buyer must have it operational. The goods will be delivered at street level. The delivery costs do not include assembly, lifting to the floor or unpacking. If these services are required, the availability and costs can be consulted at info@bloomfus.com. In no case will the material impossibility of delivering the products allow the cancellation of the sale without the consent of Bloomfus.
4. SHIPPING COSTS
Shipping costs will always be indicated in quotes and orders. You can choose to use the Buyer’s means of transport.
In the case of items that are collected by the Buyer or their transport company, Bloomfus is not responsible for any damage, breakage or loss of the transported goods once they leave the premises.
5. RETURNS
Bloomfus does not accept merchandise returns.
Upon receipt of the goods, before signing the delivery note, the Buyer must check and confirm the number of packages and their condition. If the goods cannot be checked, they must be indicated on the carrier’s delivery note as “non-conforming”.
Any anomalies observed in the packaging must be indicated on the carrier’s “delivery note” or a photo taken at the same time, as the transport agency does not accept breakages not reported on said delivery note.

All defective merchandise will be replaced and not credited, except in the event of insufficient stock. In this case, the amount of the credit will be deducted from the next invoice.
The returned Product must be delivered to the carriers in the same condition, in its original packaging and with all its accessories. No spontaneous returns will be accepted without the agreement of Bloomfus. Incident deliveries and collections will be made at street level.
Bloomfus will not be responsible for returns that do not arrive at its warehouse.
Once it arrives at the facilities, the returned product will be examined and you will be notified by email within a reasonable period of time if it will be replaced.
As these are handmade products, there may be slight variations in shades, shapes and sizes. These differences, as they do not influence the basic characteristics of the products and do not affect their quality, cannot justify a cancellation of the order or a refusal of delivery. Since an exact representation of the products on the website or in the catalogue cannot be guaranteed, Bloomfus cannot be held responsible for the inaccuracy of the photographs contained therein.
6. GUARANTEE
All materials have a 1-year warranty from the date of the invoice, provided it is a manufacturing defect.
The warranty replaces or repairs the item as many times as necessary at zero cost, but the amount is never refunded.
Exclusion: Deterioration and defects caused by normal wear and tear or by an accident due to an external factor (incorrect assembly, faulty maintenance, inappropriate use, natural disaster, etc.) or by a modification of the product not foreseen or specified by Bloomfus are excluded from this warranty.
7. FORCE MAJEURE OR FORTUNE CASE
Bloomfus will not be liable for total non-compliance, defective non-compliance or delay in the performance of any of its obligations that are caused by any event of force majeure or fortuitous event. Any deadline obligations that may exist will be suspended in these cases for the entire period in which the force majeure situation or fortuitous event continues, with the calculation resuming once this circumstance disappears.

In accordance with the provisions of article 27.3 of Law 11/1998, of July 9, on consumer protection, it is reported that complaint forms are available at the headquarters of Bloomfus SL.
Bloomfus, SL will resolve any claims that are addressed to it as quickly as possible and, in any case, within one month. In the event that this claim is not resolved satisfactorily, the out-of-court dispute resolution system indicated in the previous point may be accessed.
9. APPLICABLE LAW
The Law applicable to the Contract will be Spanish Law without prejudice to cases in which the laws of other States may be mandatory applicable.
10. RIGHT OF WITHDRAWAL
The Buyer has the right to withdraw from this contract within 14 calendar days without the need for justification.
The withdrawal period will expire 14 calendar days from the day on which the Buyer or a designated third party, other than the carrier, acquired physical possession of the goods.
To exercise the right of withdrawal, the Buyer must notify BLOOMFUS, SL – Carrer Sant Josep, 22, 08700 Igualada (Barcelona); +34 676 718 698; info@bloomfus.com. You must include your name, full address, telephone number and email address, as well as your decision to withdraw from the contract by means of an unequivocal statement.
The consumer will be responsible for bearing the costs of returning the product.
Consequences of withdrawal: In the event of withdrawal by the Buyer, Bloomfus will return all payments received. The refund may be withheld until the goods have been received.
Only the Buyer will be responsible for the decrease in value of the goods resulting from manipulation other than that necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal will not apply to contracts that refer to:
a) The supply of goods made according to the specifications of the consumer and user or clearly personalized.
b) The supply of goods that may deteriorate or expire quickly.
c) The supply of sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery.
d) The supply of sealed sound or video recordings or sealed computer programs that have been unsealed by the consumer and user after delivery.
